Terms of Service

Effective Date: October 25, 2026

These Terms of Service constitute a public offer by Sole Proprietor Ihor Pidhainyi, operating under the trade name WorkHost, to enter into an agreement for the provision of services under the terms set forth below.

WorkHost is the trade name under which Sole Proprietor Ihor Pidhainyi provides hosting, virtual server, domain name registration, and related services.

In these Terms, the term “WorkHost” refers to Sole Proprietor Ihor Pidhainyi.

By placing an order and checking the corresponding box during checkout, the Client confirms that they have read these Terms, understand their content, and agree to comply with them.

1. General Provisions

These Terms govern the ordering, payment, activation, use, renewal, and termination of WorkHost services.

The following form an integral part of these Terms:

  • Refund Policy;
  • Acceptable Use Policy;
  • Service Level Agreement (SLA);
  • special terms for specific services, if such terms are established for the respective service.

Personal data processing is carried out in accordance with the WorkHost Privacy Policy.

In the event of a conflict between these Terms and the special terms of a specific service regarding matters exclusively related to such service, the relevant special terms shall apply.

2. WorkHost Clients

WorkHost services may be used by natural persons, sole proprietors, and legal entities, unless otherwise expressly provided by these Terms, the legislation of Ukraine, sanctions restrictions, or other mandatory legal requirements.

A person placing an order on their own behalf confirms that they have the necessary legal capacity. A person placing an order on behalf of a sole proprietor, legal entity, or other organization confirms that they have the appropriate authority to enter into an agreement and use the ordered services.

WorkHost provides services to clients from various countries worldwide, except for persons and organizations whose service is expressly prohibited by these Terms, the legislation of Ukraine, applicable sanctions, or other mandatory legal restrictions.

WorkHost does not register, accept orders from, or provide services to citizens of the Russian Federation and the Republic of Belarus, regardless of their place of residence or stay, tax residency, possession of a residence permit or other citizenship, and regardless of the country from which registration, payment, or use of services is carried out. Possession of dual or multiple citizenship does not remove this restriction if the person is simultaneously a citizen of the Russian Federation or the Republic of Belarus

WorkHost also does not provide services to sole proprietors, legal entities, organizations, and other entities registered under the laws of the Russian Federation or the Republic of Belarus.

It is prohibited to deliberately conceal citizenship, use false, incomplete, or third-party registration data, documents, contact or payment details of third parties, place orders through intermediaries, or perform other actions for the purpose of obtaining services by a person to whom the restrictions established in this section apply.

Deliberate circumvention of the specified restrictions is considered by WorkHost as fraudulent activity (Fraud) within the meaning of WorkHost’s billing and anti-fraud systems and constitutes a material breach of these Terms.

If such a violation is detected, WorkHost has the right to immediately, without prior notice and without providing additional time to remedy the violation:

  • reject or cancel the order;
  • immediately suspend or permanently terminate all active and related services;
  • block the client’s account;
  • mark the order and/or account with Fraud status in the billing and anti-fraud systems;
  • block re-registration and placement of new orders;
  • add associated email addresses, domain names, IP addresses, networks, contact, payment, and other technical identifiers to internal blocking and risk control lists;
  • restrict or completely block access to websites, client portal, API, and other WorkHost resources from the respective IP addresses, networks, or other technical access sources;
  • where appropriate integration exists, transmit information about detected fraudulent activity to external services, systems, and fraud prevention databases used by WorkHost.

Information is transmitted to external anti-fraud systems to the extent necessary to detect, document, and prevent fraud, repeat registrations, abuse, and circumvention of established restrictions, in accordance with the WorkHost Privacy Policy and the legislation of Ukraine.

Funds paid for services terminated as a result of deliberate circumvention of the restrictions established in this section are not subject to voluntary refund by WorkHost. WorkHost does not provide compensation for the cost of unused periods, lost data, terminated resources, or any other voluntary reimbursement in connection with such blocking.

WorkHost is not obligated to enter into negotiations regarding restoration of a blocked account, resumption of services, refund of funds, compensation, or cancellation of the applied Fraud status.

The legislation of Ukraine applies to the relationship between WorkHost and the client. Disputes with WorkHost are resolved in the manner established by the legislation of Ukraine.

A decision of a court, arbitration, or other body of a foreign state is not in itself grounds for unblocking an account, restoring services, refunding funds, paying compensation, or WorkHost taking any other actions. Such a decision is considered by WorkHost only after its recognition and/or admission to enforcement on the territory of Ukraine in the manner established by the legislation of Ukraine. Ukrainian legislation defines recognition of a foreign court decision specifically as the extension of its legal force to the territory of Ukraine in the manner prescribed by law.

After final blocking, WorkHost fulfills requirements for restoring access, resuming services, refunding funds, compensation, or other actions only on the basis of a decision of a competent court of Ukraine that has entered into legal force, or another legally binding act that is subject to enforcement by WorkHost in accordance with the legislation of Ukraine.

Regardless of the above restrictions, WorkHost has the right to refuse to accept or fulfill any other order if the provision of the respective service contradicts the legislation of Ukraine, applicable sanctions, or other mandatory legal restrictions.

3. Services

WorkHost may provide, in particular:

  • virtual hosting services;
  • virtual private and virtual dedicated servers;
  • data storage services;
  • additional IP addresses;
  • registration, renewal, and transfer of domain names;
  • SSL certificates;
  • software licenses;
  • website and data migration;
  • server and software configuration;
  • other one-time or recurring technical services.

The specific composition, characteristics, available resources, limitations, and cost of a service are determined by its description, pricing plan, order, and invoice.

The terms of a partner or referral program are not governed by these Terms and may be defined by separate rules.

4. Order Placement and Acceptance

Before completing an order, the client is provided with the opportunity to review these Terms.

Checking the box to accept the Terms and submitting the order constitutes full and unconditional acceptance of this offer by the client.

An order may be placed through the website, client portal, or another method provided by WorkHost for the respective service.

Generation of an invoice does not in itself mean that the service has already been activated.

WorkHost has the right to refuse to fulfill an order before the service is activated if its provision is impossible for technical, legal, or other objective reasons. If payment has already been received for such an order, the rules for refunding funds for services not provided shall apply.

5. Payment for Services

WorkHost services are provided on a prepayment basis, unless expressly stated otherwise for a specific service.

Activation of a paid service is carried out after confirmation of payment receipt or use of the client’s available internal balance, credit, bonus, or other payment method permitted by WorkHost.

Available payment methods are displayed during order placement or in the client portal.

The specific list of payment methods may change without amending these Terms.

Refunds are governed by a separate Refund Policy, which is an integral part of these Terms.

6. Service Activation

Virtual hosting is typically activated automatically after payment confirmation.

Virtual private and virtual dedicated servers may be created automatically or manually depending on the respective service and available technical integration.

For servers that are processed manually, the standard activation time is up to 5 hours after payment confirmation. In most cases, the server is activated within approximately one hour, however this timeframe is not guaranteed.

The activation time for a domain name, SSL certificate, software license, or other service that depends on a third-party provider may be determined by the rules and technical capabilities of the respective provider.

7. Billing Periods and Renewal

Services may be paid for monthly, quarterly, annually, or for another period available for the respective pricing plan.

The service is provided for the paid period.

To renew a service, the client must pay the corresponding invoice by the date specified therein.

Unless otherwise expressly provided by a separately activated client feature, the mere existence of an active service does not mean automatic charges to the client’s payment method.

Refusal to continue renewal does not terminate an already paid service until the end of the current paid period, unless otherwise provided by the terms of the respective service.

8. Prices and Changes to Service Parameters

WorkHost independently sets prices for services.

Prices may change at any time, including in connection with changes in:

  • third-party provider prices;
  • cost of server and network infrastructure;
  • prices of domain name registries and registrars;
  • license costs;
  • exchange rates;
  • taxes and fees;
  • other components of service costs.

The current price is determined at the time of ordering or renewing the respective service and is displayed on the website, in the client portal, or in the invoice.

A price change does not alter the cost of an already paid period.

For the next renewal period, the current price in effect at the time of the respective renewal applies.

The client may refuse to renew the service at the new price by not paying the invoice for the next period.

WorkHost is not obligated to notify the client in advance of a price change that will apply exclusively to new orders or future renewal periods, unless otherwise expressly required by law.

An unpaid invoice does not guarantee preservation of the price specified therein. Until the time of payment, the amount may be updated according to the current cost of the service.

Prices, available configurations, and other service parameters may be automatically updated based on current data from third-party providers.

WorkHost may also change configurations, resource limits, and the composition of pricing plans for new orders and subsequent renewal periods.

Changes to pricing plan parameters must not worsen the terms already paid for by the client during the current period, except in cases of technical, legal, or other objective necessity that is beyond WorkHost’s control. In such cases, WorkHost takes reasonable measures to provide a functionally equivalent service.

9. Non-Payment and Service Suspension

In the event of non-payment of an invoice by the established deadline, WorkHost has the right to suspend provision of the respective service.

Virtual servers and data storage services may be suspended starting from the day following the date by which payment was to be made.

After suspension of a virtual server or data storage service, WorkHost does not guarantee preservation of the respective resource or data for any specified period.

The server, IP addresses, system snapshots, backups, and other related resources may be permanently deleted or reallocated in accordance with the infrastructure provider’s terms.

Non-payment may result in data loss, and the possibility of subsequent service restoration is not guaranteed.

This approach corresponds to the actual upstream infrastructure model: the provider may suspend an unpaid service and reuse resources, and data loss after overdue payment is not explicitly excluded.

For virtual hosting, WorkHost has the right to suspend the account after the paid period expires and subsequently delete it along with hosted data.

The client must not rely on an unpaid period as a guaranteed data retention period and is obligated to create their own copies of necessary information in advance

10. Virtual Hosting and Backups

WorkHost performs automatic backups of websites hosted within virtual hosting services.

Backups are performed approximately once every 7 days.

Up to three backups may be stored simultaneously for one website. The maximum retention period for an individual backup is up to 30 days.

The specified backups are an additional means of data protection and do not replace the client’s own backups.

WorkHost does not guarantee the availability of a backup for a specific date if its creation or preservation became impossible due to a technical failure, data corruption, resource overrun, or other circumstances.

The client is obligated to independently maintain current backups of critically important information.

11. Virtual Servers

A client using an unmanaged virtual server is independently responsible for:

  • the operating system;
  • installed software;
  • server configuration;
  • updates;
  • information security;
  • passwords and access keys;
  • backups;
  • data stored on the server;
  • actions of users to whom they have granted access.

The availability of technical capability to reboot, reinstall the system, change passwords, create snapshots, or perform other actions in the client portal does not impose on WorkHost responsibility for the consequences of such actions performed by the client.

Terms for managed servers may be defined by separate special terms of the respective pricing plan.

For plans with extended management, including comprehensive administration services, separate terms, scope of support, and communication channels may apply.

12. Domains

When providing domain name registration, renewal, or transfer services, WorkHost may act as an intermediary between the client and the respective registrar or registry.

The client is the registrant of the domain name, unless otherwise determined by the rules of the respective domain zone.

Domain name registration and use are also governed by the rules of the respective registry or registrar.

WorkHost cannot guarantee domain name registration solely on the basis that it appeared as available during verification.

The right to a domain arises after successful completion of its registration by the respective registry.

The client may submit a request to transfer a domain name to another registrar.

Before transferring a domain, WorkHost has the right to verify the client’s identity, their authority, and right to dispose of the respective domain.

Transfer may also be restricted by domain zone rules, registry, registrar, legislation, or technical limitations.

13. SSL Certificates, Licenses, and Third-Party Digital Products

Certain WorkHost services may include ordering SSL certificates, software licenses, or other products from third-party providers.

Such products may be additionally subject to license terms, usage rules, and restrictions of the respective provider.

The client undertakes to comply with such terms to the extent necessary for lawful use of the respective product.

Prices, availability, and characteristics of third-party products may change depending on the terms of their providers.

14. Migration and One-Time Work

WorkHost may provide services for transferring websites, data, email, server configuration, software, and other one-time technical work.

The scope of such work is determined by the service description, order, technical specification, or agreement of the parties.

The client is obligated to provide necessary and valid access credentials, information, and materials without which the work cannot be performed.

The completion deadline may be extended by the time of delay caused by the client’s failure to provide necessary information, access, or other circumstances beyond WorkHost’s control.

15. Acceptable Use of Services

WorkHost services may not be used for activities that violate legislation, third-party rights, the security of WorkHost infrastructure, or third-party networks.

In particular, use of services is prohibited for:

  • sending spam;
  • phishing and fraud;
  • distributing malicious software;
  • botnets;
  • attacks or facilitating attacks on third-party systems;
  • unauthorized scanning and brute-force access attempts;
  • violation of copyright and other intellectual property rights;
  • hosting pornographic and erotic materials;
  • resources whose primary purpose is political agitation or propaganda;
  • other activities prohibited by the Acceptable Use Policy.

It is prohibited to use WorkHost services to create, host, or provide VPN services, proxy services, anonymizers, and other services for concealing or redirecting network traffic.

Use of computing resources for cryptocurrency mining and other activities that create sustained or disproportionate load on the processor, graphics accelerators, disk subsystem, network, or other infrastructure is prohibited.

Hosting and operation of public P2P, torrent, and other file-sharing services intended for mass file distribution is prohibited, as well as use of services for distributing materials in violation of copyright and other intellectual property rights.

In the event of a serious violation, security threat, phishing, malware distribution, DDoS activity, spam, or other situation requiring immediate response, WorkHost has the right to immediately suspend access to the service without prior notice to the client.

16. Engagement of Third-Party Providers

To provide services, WorkHost may use infrastructure, software, and services of third-party providers, including data centers, server infrastructure operators, domain name registrars, certification authorities, and licensors.

WorkHost has the right to change such a provider if this does not deprive the client of the essence of the already paid service.

The client agrees that certain technical characteristics, operation completion times, and feature availability may depend on the third-party provider.

WorkHost does not guarantee uninterrupted operation of third-party provider systems that are beyond WorkHost’s reasonable control.

17. Technical Maintenance and Availability

To ensure security, stability, and infrastructure development, WorkHost may conduct scheduled and emergency technical work.

During such work, certain services may be temporarily unavailable.

Specific availability guarantees, downtime accounting procedures, and compensation, if provided for the respective service, are defined by the Service Level Agreement (SLA).

18. Technical Support

For registered clients, the primary channel for inquiries regarding active services, billing, account, and other matters requiring client identification is the ticket system in the client portal.

For unregistered users, email, online chat, and other channels specified on the website may be available.

For certain managed services, additional or dedicated communication channels may be provided in accordance with the terms of the respective pricing plan.

WorkHost has the right to require inquiries through the client portal or additional identity verification before performing actions that may affect the security of the account, server, domain name, payment data, or other client resources.

19. Client Obligations

The client is obligated to:

  • provide accurate and current contact and registration information;
  • ensure confidentiality of their passwords and other authentication credentials;
  • pay invoices on time;
  • not use services in violation of legislation and these Terms;
  • monitor the validity periods of their own services and domain names;
  • independently maintain backups of important data;
  • respond promptly to WorkHost notifications regarding security, violations, or the need to perform certain actions.

The client is responsible for the actions of persons to whom they have voluntarily granted access to their account or services.

20. Service Suspension and Termination

WorkHost has the right to suspend or terminate a service in the event of:

  • non-payment;
  • violation of these Terms or the Acceptable Use Policy;
  • creation of a threat to infrastructure security or stability;
  • receipt of a substantiated complaint regarding illegal activity;
  • need to comply with a mandatory requirement of a competent authority;
  • application of sanctions or other legal restrictions;
  • use of the service in a manner that may cause harm to WorkHost, a third-party provider, or other users.

If the nature of the violation allows it to be remedied without immediate blocking, WorkHost may provide the client with time to remedy the violation.

In situations requiring immediate response, the service may be suspended without prior notice.

21. Liability

WorkHost is responsible for proper provision of services within the scope of these Terms, the description of the respective service, and applicable legislation.

WorkHost is not liable for interruptions or losses caused by circumstances beyond its reasonable control, including global network failures, third-party infrastructure failures, actions of third parties, attacks, force majeure circumstances, or actions of the client themselves.

This provision does not limit WorkHost’s liability in cases where such liability cannot be limited under legislation.

WorkHost is not liable for data loss on an unmanaged virtual server if the backup obligation was not expressly included in the purchased service.

22. Personal Data

WorkHost processes clients’ personal data to the extent necessary for account registration, order placement and fulfillment, billing, technical support, compliance with legal obligations, and security.

The procedure for processing personal data is detailed in the Privacy Policy.

Conclusion and performance of a contract is an independent legal basis for processing personal data necessary for the performance of such contract; the law also requires informing the person about the data controller, purpose of collection, and recipients when collecting data.

23. Refunds

The terms, deadlines, and procedure for refunds are defined by the Refund Policy, which is an integral part of these Terms.

If special refund rules are established for a specific service, they apply together with the Refund Policy.

These Terms and the Refund Policy do not limit the client’s rights that cannot be limited by contract under legislation.

24. Changes to Terms

WorkHost has the right to change these Terms.

The current version is published on the WorkHost website with indication of the effective date.

The new version applies to new orders and subsequent service renewal periods, starting from the date it enters into force.

Changes do not apply retroactively in a manner that would worsen the terms of a period already paid for by the client, except in cases where the respective change is mandatory under legislation or caused by circumstances that WorkHost objectively cannot control.

WorkHost is not obligated to provide separate notification to clients about each editorial or non-material change to these Terms, unless otherwise required by legislation.

25. Applicable Law and Disputes

The legislation of Ukraine applies to the relationship between WorkHost and the client, unless otherwise follows from mandatory provisions of legislation that are applicable to a specific client.

The parties will attempt to resolve disputes through negotiations and by contacting the support service.

If it is impossible to resolve a dispute through negotiations, it is resolved in accordance with applicable legislation.

26. Final Provisions

If a particular provision of these Terms proves to be invalid, illegal, or unenforceable, this does not terminate the effect of other provisions.

WorkHost’s failure to exercise a particular right in a specific case does not constitute a waiver of such right in the future.

Section headings are used for convenience and do not change the meaning of the respective provisions.

The current version of these Terms is permanently available on the WorkHost website.

27. Legal Details

The provider of services under these Terms is Sole Proprietor Pidhainyi Ihor Viktorovych, conducting business under the commercial name WorkHost.

Bank Details

Payment for WorkHost services may be made using the payment methods available during the ordering process, through the Client Area, or using the payment details specified in the relevant invoice.

If any bank, payment or contact details change, the current details published on the WorkHost website, displayed in the Client Area, or specified in the invoice issued for the relevant payment shall be deemed valid.

The Client must use only the payment details and payment reference specified in the relevant invoice or otherwise provided by WorkHost for the particular transaction.
