Developer Hosting Public Offer

Public Agreement for the Provision of Developer Hosting Services by WorkHost

Version: 1.0

Effective Date: October 20, 2026

1. General Provisions

1.1. The Service Provider under this Agreement is Individual Entrepreneur Ihor Pidhainyi, who conducts business under the trade name WorkHost (hereinafter referred to as the “Service Provider” or “WorkHost”).

1.2. This Agreement sets out the specific terms governing the provision and use of services under the Developer Hosting plans.

The Customer is an individual, an individual entrepreneur, or a legal entity that orders the relevant service and accepts the terms of this Agreement.

1.3. Developer Hosting is a special web hosting program offering preferential terms for web developers, programmers, web designers, system administrators, IT students, and other individuals involved in developing, testing, or maintaining web projects. Participation in the program requires compliance with specific requirements concerning a personal IT website, the use of server resources, and the hosting of client projects.

1.4. This Agreement constitutes a special addendum to the general WorkHost Public Offer. Matters directly related to the Developer Hosting program are governed by the provisions of this Agreement, while all other matters are governed by the general WorkHost Terms of Service and applicable Ukrainian law.

1.5. This Agreement is concluded electronically. Acceptance occurs when the Customer confirms their agreement to its terms while placing an order through the WorkHost billing system. Before confirming the order, the Customer is given the opportunity to review the full text of this Agreement, the features of the selected plan, and its price.

1.6. In matters directly concerning the specific terms of Developer Hosting, the provisions of this Agreement take precedence over the general WorkHost terms, unless otherwise provided by law.

1.7. By accepting the terms of this Agreement, the Customer confirms that they have read its provisions and understand the specific purpose of the service, the applicable technical limitations, the rules of use, and the potential consequences of violating them.

2. Subject Matter of the Agreement

2.1. The Service Provider provides the Customer with hosting services for websites, databases, and related data on WorkHost’s server infrastructure. Services are managed through the EnhanceCP control panel. The specific technical specifications, features, limitations, and pricing are determined by the terms of the selected hosting plan published on the WorkHost website.

2.2. The number of websites and client accounts, disk space, RAM, and other resources are limited by the specifications of the selected plan. Creating separate EnhanceCP client accounts does not increase the total website limit or the available server resources.

2.3. Depending on the selected plan, the Customer may have access to the following features:

  • Hosting a personal IT website.
  • Creating, developing, and testing web projects.
  • Installing supported CMS platforms and web applications.
  • Hosting client websites.
  • Creating separate accounts for clients.
  • Applying custom branding to the EnhanceCP control panel.
  • Reselling hosting services.
  • Participating in the WorkHost affiliate program.

2.4. Developer Hosting does not include a dedicated physical server or VPS for each Customer. The service is provided on shared server infrastructure. Operating system administration, code fixes, website development, and troubleshooting third-party software are not included in the standard service fee.

2.5. Developer Hosting services provide a server environment for hosting web projects.

Website development, CMS configuration, code optimization, fixing security vulnerabilities, cleaning infected websites, and administering client projects are not included in the standard service fee unless expressly included in the plan or agreed separately.

2.6. The Service Provider ensures the operation of the server infrastructure within the scope of its contractual obligations. The Customer is solely responsible for the configuration, technical condition, and security of the software they install on the hosting service.

3. Mandatory Personal IT Website

3.1. Participation in the Developer Hosting program requires the Customer to have one website of their own presenting their activities in the field of information technology. Each plan reserves one website slot for this purpose, which may not be used to host projects unrelated to IT.

3.2. The personal IT website must contain substantive and accurate information reflecting the Customer’s actual field of activity. Depending on their specialization, this may include descriptions of professional services, software products, original work, a portfolio, professional skills, educational projects, technical publications, or other relevant materials. The website must include valid contact details through which the Customer can be reached.

Commercial experience, a registered business, or completed client projects are not required. Students and beginners may showcase their own educational projects, personal work, and professional interests, provided that the information presented is accurate.

3.3. The use of ready-made templates for WordPress, Elementor, HTML, and other systems is permitted, provided they are used lawfully. However, an installed template with unmodified demo content does not qualify as a complete personal IT website.

Empty CMS installations, default placeholder pages, demo sites imported from template marketplaces, websites featuring fictitious services or portfolios, demo contact details, and other resources that merely simulate the activities of an IT professional do not meet the program requirements. To demonstrate compliance, the Customer must personalize the website, add relevant content, and provide their own valid contact details.

3.4. The Service Provider does not set a specific deadline for creating a personal IT website during the current paid service period. The Customer may develop, add content to, and improve their website gradually. Under the Developer Start, Pro, and Expert plans, the Customer may begin hosting client websites before completing their own IT website, provided that one website slot remains reserved for it.

The absence of a ready-made personal IT website during the current paid period does not, in itself, constitute a breach of the Agreement.

3.5. The space provided for a personal IT website is for a specific purpose only. Hosting a website on a different topic in its place, including temporary or test sites, is strictly prohibited regardless of the duration of such use.

In the event this violation is detected, the Contractor reserves the right to immediately, without prior notice, terminate the service of the non-compliant website and delete it along with associated data in a manner permitted by applicable law. This restriction does not apply to additional client websites allowed by the tariff plan.

3.6. The presence of a fully functional personal IT website that meets the requirements of this section is a mandatory condition for upgrading the tariff plan and renewing Developer hosting for the next paid period.

The Contractor has the right to verify the thematic compliance, accuracy of contact data, and substantive content of the website before approving the relevant operation. If the website is missing or does not meet the established requirements, a tariff upgrade or service renewal is not permitted until the non-compliance is resolved.

4. Hosting Client Websites and Reselling Hosting

4.1. The Developer Start, Pro, and Expert tariffs allow the Customer to host their own clients’ websites and resell hosting services within the purchased tariff plan. The subject matter of such websites is not limited to the field of information technology; however, their content and purpose must comply with the law and the general rules for using WorkHost services.

4.2. The Customer independently determines the cost of services for their clients, the procedure for accepting payments, and the commercial terms of cooperation. Separate EnhanceCP accounts may be used for client service, as well as custom control panel branding within the capabilities of the chosen tariff. Developer Hosting does not provide full EnhanceCP API access or integration of third-party billing systems for automated resale.

4.3. All client websites use the resources of the Customer’s main tariff. One client may receive several websites within the available limit, but this accordingly reduces the number of slots for other projects. Providing a separate client account does not create an additional resource quota.

4.4. WorkHost is not a party to agreements between the Customer and their clients. The Customer is solely responsible for mutual settlements, fulfillment of commercial agreements, technical support of client projects, and their compliance with the terms of this Agreement. Violations committed on a client website may lead to restrictions on its operation and, if necessary, to the suspension of the Customer’s main service.

5. Software Usage and Security

5.1. The Customer has the right to use CMS, web applications, and other software components compatible with the hosting environment within the technical specifications of the tariff. They are solely responsible for the installation, configuration, timely updates, and security of the software, including client websites.

5.2. The use of pirated or modified versions of commercial software intended to bypass licensing, including cracked themes and plugins, is prohibited. It is also prohibited to host cryptocurrency miners, backdoors, malicious scripts, botnet components, programs for unauthorized access, and other software that poses a threat to the server infrastructure or third parties.
These restrictions do not apply to the legal use and modification of open-source software.

5.3. The Customer is obliged to promptly eliminate detected vulnerabilities, infections, and other security issues. The Contractor has the right to immediately isolate or block a dangerous website regardless of whether the problem arose as a result of the Customer’s intentional actions, programming errors, or unauthorized access by third parties.

The unintentional nature of an infection does not relieve the Customer of the obligation to eliminate the threat, but in itself does not mean an automatic final termination of the service.

6. Server Resources and Tariff Restrictions

6.1. The Customer is obliged to comply with the technical limitations of the chosen tariff, in particular regarding the number of websites, client accounts, disk space, CPU time, RAM, number of processes, files, directories, and other resources. Specific limit values are determined by the published characteristics of the corresponding tariff.

6.2. Intentional bypassing of tariff limits by using WordPress Multisite, additional subdomains, subdirectories, alternative web server configurations, or other mechanisms for the hidden hosting of more independent websites than provided for by the tariff is prohibited.

Domain aliases, service subdomains, and auxiliary components of a single web project are not considered separate websites solely by the fact of their existence, provided they are not used to bypass established limits.

6.3. The Customer must not create a load that threatens the stability of the server infrastructure or the work of other users. Systematic overloading of the processor, RAM, databases, or disk subsystem due to unoptimized code, uncontrolled background processes, excessive tasks, or other reasons may be grounds for applying technical restrictions.

Briefly reaching the established limit is not considered a violation in itself, provided it is not accompanied by a bypass of restrictions or a threat to other users.

6.4. In the event of a critical load, the Contractor has the right to immediately limit resource consumption or suspend the operation of the problematic website without prior notice. The Customer is obliged to eliminate the cause of the overload or switch to a tariff whose resources meet the needs of their projects.

7. Email

7.1. The email capabilities of Developer Hosting are intended for business correspondence, contact form operation, website notifications, and other common needs of hosted projects. The number of mailboxes and daily limits for outgoing messages are determined by the characteristics of the tariff plan.

7.2. Outgoing mail limits apply to messages sent through WorkHost mail servers. Messages sent via independent third-party SMTP/API services are not counted toward these limits. The number of incoming messages is not limited by a separate tariff quota; however, their storage is counted toward the available disk space; technical measures to counter abuse may also be applied.

7.3. The use of Developer hosting for spam, phishing, mass advertising mailings, organizing email marketing services, and other email abuses is prohibited. The prohibition also applies to sending such messages from hosted sites via third-party SMTP/API services.

In the event a violation is detected, the Contractor has the right to immediately restrict the sending of mail or suspend the operation of the relevant website or account.

6.4. In the event of a critical load, the Contractor has the right to immediately limit resource consumption or suspend the operation of the problematic website without prior notice. The Customer is obliged to eliminate the cause of the overload or switch to a tariff whose resources meet the needs of their projects.

4.5. Protection of End-Client Interests

4.5. Regardless of the reasons for terminating the Customer’s service under the Developer hosting program, including their failure to comply with the terms of the Agreement, voluntary termination of activities, loss of contact, prolonged absence, or other circumstances, the Contractor provides for the possibility of further servicing the hosted client websites and associated domain names without the Customer’s participation.

Termination of Developer hosting does not mean the automatic termination of the rights of end clients to their websites, domain names, and information. After establishing identity and verifying the relevant rights, the end client may independently determine the further procedure for servicing their resources: establish direct contractual relations with WorkHost at current general tariffs or initiate their transfer to another service provider in the established manner.

The transfer of client resources to a former Developer hosting Customer is carried out exclusively upon a separate written application from the relevant right holder, signed with a QES, after verifying their identity and authority. Operations with domain names are additionally carried out in accordance with the rules of registrars and relevant domain registries.

The absence of an application to transfer resources to the former Customer is not considered the end client’s consent to such a transfer. Direct paid service from WorkHost is established only after the end client accepts the relevant contractual terms.

8. Registration and Prevention of Abuse

8.1. The Customer is obliged to provide accurate registration data, use a valid email address, and confirm it according to the established procedure. The registration of fictitious accounts or the use of false data for the purpose of obtaining discounted services is not permitted.

8.2. A single person is prohibited from creating multiple WorkHost client accounts for the repeated receipt of Developer hosting discounted tariffs, bypassing the limit on the number of websites, or other special program conditions.

To prevent abuse, the Contractor may analyze available registration, technical, and payment data within the framework of current legislation. Individual matches of names, IP addresses, or other data are not considered absolute proof of a violation. Confirmed intentional multi-accounting may be grounds for blocking the relevant accounts and terminating services.

8.3. The creation of separate EnhanceCP client accounts within the permitted hosting resale is not considered a violation of the rules of this section.

9. Developer Hosting Discounted Affiliate Program

9.1. Customers of Developer hosting tariff plans are entitled to participate in a special WorkHost discounted affiliate program. This program is an additional benefit of Developer hosting and operates under the terms defined by this Agreement. It differs from the general WorkHost affiliate program, which is governed by a separate public offer.

9.2. The amount of the affiliate reward depends on the Developer hosting tariff plan and the category of services purchased by the referred clients:

Tariff Plan Hosting and VPS Domains
Developer Light 12% 5%
Developer Start 12% 3%
Developer Pro 12% 3%
Developer Expert 15% 3%

The specified rates apply to the relevant payments of referred clients, provided that the rules of the discounted affiliate program are followed.

9.3. The affiliate reward is calculated for actually paid services that referred clients order directly from WorkHost. The reward is calculated for both the initial order and subsequent paid renewals of the relevant services. In the event of termination of payment for a certain service, the calculation of the reward for it also ceases.

9.4. The discounted affiliate program does not apply to client websites hosted within the Customer’s own Developer hosting or Reseller hosting. In such cases, the Customer independently sets the cost of services and receives payment directly from their clients. If a referred client, by their own consent, transfers a site from direct WorkHost hosting to the partner’s hosting, the calculation of the reward for the service that is no longer paid to WorkHost ceases. Rewards for other services of this client may continue to be calculated.

9.5. The use of self-referrals, fictitious orders, dummy accounts, and other methods of artificially obtaining affiliate rewards is prohibited. In the event such violations are confirmed, the Contractor has the right to cancel improperly calculated rewards and limit the Customer’s participation in the affiliate program.

9.6. The discounted terms of the affiliate program are provided as part of the Customer’s participation in Developer hosting. The general WorkHost affiliate program is an independent program with separate terms of participation, calculation, and payment of rewards, determined by its own public offer.

9.7. Conditions for receiving the discounted reward. Affiliate accruals at special Developer hosting rates are conditional upon confirmation of the Customer’s fulfillment of the mandatory program requirements, in particular the requirements regarding the personal IT website. The display of the relevant amounts on the affiliate balance does not mean their unconditional confirmation for payment. The procedure for final confirmation of the reward is determined by this Agreement.

9.8. Termination of participation and recalculation of reward. In the event of termination of Developer hosting due to the Customer’s failure to fulfill the mandatory program conditions, the right to receive unconfirmed discounted affiliate accruals ceases, and the relevant amounts are subject to cancellation. At its own discretion, the Contractor may, instead of full cancellation, recalculate such accruals at the rates of the general WorkHost affiliate program in effect on the date of termination of Developer hosting. Recalculation does not mean the Customer automatically acquires the status of a participant in the general affiliate program.

9.9. Procedure for Withdrawing Affiliate Rewards

9.9. The withdrawal of funds from the affiliate account is carried out upon the Customer’s request, provided that the established minimum amount of confirmed affiliate reward is reached. Minimum amounts and available withdrawal methods are determined as follows:

  • 10 USD — credit to the internal balance of the WorkHost client account for subsequent payment of the Contractor’s services. This method is available to all program participants regardless of their country of residence.
  • 20 USD — payment to a Ukrainian bank payment card in Hryvnia equivalent for Customers from Ukraine.
  • 20 USD — payment to a PayPal account for Customers from other countries.

Minimum withdrawal amounts are set in Euros regardless of the currency of the actual payment. In the case of payment to a Ukrainian bank card, the amount is converted into Hryvnia at the rate determined for the relevant payment transaction and communicated to the Customer before its execution.

Withdrawal of funds in an amount less than the established minimum for the chosen method is not carried out. Unwithdrawn affiliate rewards accumulate in the affiliate account, subject to other provisions of this Agreement.

9.10. Advertising and Promotion Rules

9.10. Participants in the Developer hosting discounted affiliate program are obliged to comply with the rules for advertising and promoting WorkHost services established by the Contractor’s general affiliate program. In particular, partners are prohibited from:

  • Independently using their own referral links to register accounts, order services, or receive affiliate rewards for their own payments.
  • Placing WorkHost affiliate links and advertising materials on resources whose content or activities violate current legislation.
  • Placing WorkHost contextual and display advertising in search engines, in particular using the name WorkHost, its spelling variants, trademarks, and the Contractor’s domain names in paid advertising campaigns without separate written permission from the Contractor.
  • Using forced redirects, hidden installation of referral cookies, or other technical means that lead to the crediting of referrals without the user’s conscious click on the affiliate link.
  • Distributing false or misleading advertising, posing as an official representative of WorkHost without appropriate authority, using spam, and other illegal ways of attracting clients.

A confirmed violation of these rules is grounds for limiting or terminating participation in the discounted affiliate program, as well as reviewing improperly calculated rewards in accordance with this Agreement.

Other requirements for advertising and promoting services are determined by the rules of the general WorkHost affiliate program in the part that does not contradict the special conditions of Developer hosting.

10. Payment, Tariff Change, and Service Renewal

10.1. Developer hosting is provided on a prepaid basis. The cost of the service, available payment periods, and tariff characteristics are indicated on the official WorkHost website and confirmed during the ordering process.

10.2. The Customer has the right to request a tariff plan upgrade. Such an upgrade is permitted only after confirming the compliance of the personal IT website with the requirements of Section 3 of this Agreement. The terms for recalculating the paid period, the top-up amount, and the next renewal date are determined and communicated to the Customer before the tariff change is confirmed.

The specified rates apply to the relevant payments of referred clients, provided that the rules of the discounted affiliate program are followed.

10.3. Renewal of Developer hosting for the next paid period is possible exclusively on the condition of having a fully functional personal IT website. The mere fact of using the service during the previous period or receiving an invoice for its renewal does not waive this requirement.

If the personal IT website is missing or does not meet the program conditions, the Contractor may refuse renewal until the non-compliance is resolved. In the event of receiving payment for a renewal that was not approved, the issue of refunding or other legal settlement of such payment is resolved in accordance with the terms of the Agreement and legislation.

10.4. Termination of Service

10.4. In the event of non-payment for renewal or the Contractor’s refusal to renew Developer Hosting due to the Customer’s failure to comply with the terms of this Agreement, the provision of the service ceases after the end of the current paid period. Funds for services actually provided are not returned. Termination of service deprives the Customer of the right to further use the tariff resources and participate in the discounted affiliate program. Unconfirmed affiliate accruals are canceled or recalculated in accordance with Section 9 of this Agreement. Termination of service does not grant the Customer an automatic right to transfer, receive, or pass on to third parties client websites, domain names, and associated data.

11. Backup and Data Responsibility

11.1. Backup tools, if provided by the tariff, are provided in accordance with its technical characteristics. The Customer is obliged to independently take appropriate measures to preserve important information, in particular to create independent backup copies of websites, databases, and client projects.

It is recommended to store such copies outside the hosting account, as their availability should not depend on the status of the main service.

11.2. Blocking or terminating the service may restrict access to hosted files, databases, mailboxes, and backup copies. After the final deletion of the relevant data, its recovery may be technically impossible.

11.3. The Customer is responsible for the proper backup of their own clients’ data. The Contractor’s responsibility for the preservation and availability of data is determined by the agreed terms of service and the legislation of Ukraine; these provisions do not limit the Customer’s rights that cannot be excluded by contract.

12. Violation of Terms and Termination of Service

12.1. In the event of a breach of this Agreement, the Contractor has the right to apply measures necessary to eliminate the breach or protect the server infrastructure: restrict certain functions, block outgoing mail, suspend the operation of an individual website or client account, and, if there are appropriate grounds, terminate the provision of the service.

12.2. Immediate protective blocking without prior notice is permitted in cases of detecting active malicious software, spam, phishing, network attacks, cryptocurrency mining, critical server load, and other threats to the security or stability of the infrastructure. Such blocking may be applied regardless of the Customer’s intent.

12.3. Grounds for final termination of service may include confirmed intentional multi-accounting, systematic bypassing of tariff limits, intentional hosting of malicious software, organization of network attacks, spam, phishing, and repeated creation of critical threats after a request to eliminate the violation.

12.4. A separate ground for immediate termination of service and deletion of a specific website is the use of space intended for a personal IT website for a project with a different subject matter, even if such hosting was temporary. The relevant procedure is applied taking into account the requirements of current legislation.

12.5. Final termination of the service may be accompanied by the deletion of associated websites, databases, mailboxes, and other information in the manner established by the agreement and legislation. The Customer is warned about the possibility of irreversible data loss and the need for independent backup.

13. Liability of the Parties and Final Provisions

13.1. The Contractor undertakes to provide services in accordance with the agreed characteristics of the tariff. The Customer is responsible for the legality of the hosted content, compliance with the rights of third parties, use of server resources, security of the installed software, and the activities of users to whom they have granted access to their web projects.

13.2. The processing of the Customer’s personal data is carried out for the conclusion and execution of the Agreement, provision of services, conducting settlements, ensuring security, and other legal purposes in accordance with the WorkHost Privacy Policy. The Customer independently ensures the legality of the processing of personal data that they place on their own and client websites.

13.3. The Contractor has the right to update the terms of this Agreement in connection with changes in legislation, the development of services, or justified technical needs. The current version is published on the official WorkHost website. Significant changes affecting the rights and obligations of current Customers are communicated in accordance with the law and general terms of service.

13.4. Disputes between the parties are resolved through negotiations, and in case of failure to reach an agreement, in the manner established by law. No provision of this Agreement can be interpreted as a limitation of the Customer’s rights or an exemption of the Contractor from liability in cases where this is
